The Communications and Media Commission confirmed today, Monday, that the court ruling issued by the Rusafa First Instance Court does not reinstate Korek Telecom, emphasizing that the debts owed to the state remain and the closure procedures for its offices are ongoing.
The Commission stated in a statement received by the Video News Agency that it has followed what some media outlets and social media platforms reported regarding the ruling issued by the Baghdad Rusafa Appeals Presidency / Rusafa First Instance Court in the case numbered (2013/ ب/2026) on September 28, 2026, and the inaccurate interpretations that suggest the cancellation of the measures taken by the Commission against Korek Telecom.
It clarified that the subject of the case and the ruling focused on the Commission's letter numbered (1/ر/6417) dated June 2, 2026, which included the cancellation of the settlement contract numbered (53) dated September 23, 2025, related to the scheduling of financial debts owed by the company to the Commission. The court ruled to cancel the mentioned letter and consider the settlement contract valid between the two parties.
It confirmed that the ruling did not include any text or indication to cancel the other regulatory and legal measures taken against the company, including the closure of its offices, as these measures are based primarily on the expiration of the mobile services license contract concluded with the company on August 30, 2022, a fact established by the court in the reasoning of its ruling, whereby these procedures remain in effect unless a court decision explicitly states their cancellation.
It noted that the ruling did not grant the company a license or renew its license, and that the validity of the settlement contract means that the company remains obligated to pay the debts confirmed against it to the state, in addition to the additional dues owed by it, and the ruling does not absolve it from any of those obligations.
The Commission affirmed its full respect for the judiciary and the decisions of the competent courts, and its continued adherence to legal and judicial pathways in all procedures related to the Korek Telecom case, including pursuing appeal routes guaranteed by law within the specified timeframes, to preserve the rights of the state, the public interest, and users' rights, in accordance with the applicable laws and regulations.
It emphasized that the offices of Korek Telecom, which were previously closed under the regulatory measures taken against it, remain closed, and that any reopening of these offices by the company without the Commission's approval will legally and administratively fall under the company's responsibility, and shall not be considered in any way as implementation of the court ruling or approval from the Commission to resume its activities.
